Terms and Conditions of Offer of Sale
The under mentioned Terms and Conditions of Offer of Sale (“Terms of Offer of Sale”) of the Website www.Trolleybay.com (hereinafter referred to as “Website”) acts as an agreement made between Mascot Retail Pvt Ltd., d/b/a and t/a HooksandHinges (hereinafter referred to as “Mascot Retail Pvt Ltd.” and or “ HooksandHinges” and or “Hooks&Hinges” and or “Trolleybay” and or “We” and or “Us” and or “Our”)
User(s)/Registrant(s)/Buyer(s) on the Website (hereinafter referred to as “User” and or “You” and or “Your” and or “Yourself”) describe, inter alia, the terms and condition on which Mascot Retail Pvt Ltd. offers the User for sale, to access and or transact and or purchase goods and services either through cash vouchers, coupons, redemption coupon or any other offers or otherwise on the Website and the Service(s) (as described below) through the Website by way of registering and or without registering on the Website as the Registered User using the computer systems or mobile or other electronic device(s).
We strongly recommend all our Users to please read the Terms of Offer of Sale carefully before purchasing any product or availing any of the Services on the Website. Any purchase of Product or Services made by You on the Website shall automatically implies that You have read, understood, and agree with the Terms of Sale and shall be legally binding on You.
1. General information
1.1 The Website only serves as a platform for the online sale and purchase of branded and unbranded Products (“Products”) or Services (“Services”) offered by Website’s various affiliates/ registered merchants/ vendors/ affiliates/ sellers/ service providers (hereinafter referred to as “Vendors”) of Trolleybay for its Users. The Services offered to the User through varied channels, which may include sale vouchers or redemption vouchers for different products and Services. The Vendors who are the sellers of the products or services on the Website will be solely responsible to You for the products sold or for redemption of the vouchers purchased or offered to You through the Website.
1.2 You indemnify Us that We have the sole authority and the right to amend, discontinue any Products or Services at any time without any prior notice to its User(s). You further indemnify Us that We may also add or change the processes, conditions or modes of purchase at any time to adapt to changes that We may make in the Services We offer. You hereby agree that Trolleybay is not liable to You or any third party for any changes, modification, suspension, or discontinuation of any Service or its part.
2. Amendment to Terms of Offer of Sale Agreement
3.1 Trolleybay may from time to time provide against payment or against promotion Vouchers of a specific monetary value. The price displayed on the Voucher is inclusive of all applicable Taxes unless mentioned otherwise.
3.2 Trolleybay will facilitate the provision of the best & pre-negotiated deals for a particular Products/ Services at a given price and place. You shall be eligible to purchase Vouchers of a specific monetary value, which will be subject to the Terms of Offer for Sale and other terms, if any, as specified by the Vendor.
3.3 The vouchers may contain an offer period (or an expiry date) mentioned on it, and shall be used accordingly. You also cannot use the vouchers during a particular period (if any mentioned on the voucher). Unless stated these vouchers cannot be used to redeem any credit or cash-back for the value of the voucher. You further agree that the voucher issued is specific to particular Product or Services such as restaurants, salon, footwear etc. and cannot be used for purchase of any other Product/ Service and cannot be used alongwith any other offers or promotions that may be made available.
3.4 If You make any payment for the voucher through any mode, including cash on delivery, You will be issued a voucher, which must be presented to the store or the venue and cannot be used for the purchase of any other Product or Service. Vouchers once sold are not refundable, whether you use it or not. Also only one voucher is allowed per transaction. You also agree that neither Trolleybay nor its vendors are liable in the event you lose, misplace or destroy your voucher at any time.
4.1 Trolleybay through its online platform makes available variety of Products and Services at a price agreed to You. Purchase of such products will be subject to Terms of Offer for Sale and other additional terms and conditions of the Website.
4.2 We also offer the shipping for all the products sold on the Website as per the company’s policy which might change at any time without any prior notification. Octroi if any shall be borne by Us and shall not be borne by the User.
4.3 The price of the product mentioned on the Website will be either equal to or less than the Maximum Retail Price (hereinafter referred to as “MRP”) of the product on the website. The MRP and other statutory declarations shall be mentioned on the products or its packaging as per applicable laws. The warranties on the products are provided by the respective manufacturers/ brands. In case of special warranty or warranty that is specifically covered by Seller of that product, it shall be mentioned on the respective product page and/ or on the packaging.
4.4 In case of purchasing any electronic Products from the Vendors, Trolleybay will not be liable for any fault arising from them. Therefore the customers are requested to visit their nearest service center of the respective manufacturer of the product to get any faults checked and rectified in the electronic product. In case there is no service center close to your area, Trolleybay will recall the Product upon your request and send it to service center on Your behalf where the service center personnel will get in touch with You directly for the cost incurred.
5.1 You shall take all responsibility for your own actions in utilizing the Services purchased by You where Trolleybay is not liable at all for Your actions.
5.2 Trolleybay will also not be entitled to any refunds of the Services once availed from Our Website unless any error has occurred during the purchase of redemption of such Services.
5.3 You also confirm that You are of the legal age to form any binding contract with Trolleybay and also not barred from using any Services in India.
6. Pricing Information
6.1 Trolleybay strives to ensure in providing Our customers with the best possible prices of the Products and Services available on the Website. However, We cannot guarantee the prices will be lowest in the city, region, or geography available. Prices and availability of the Products or Services are subject to change at any time without any prior notification.
6.2 Trolleybay tries to provide accurate Product and Services with accurate prices, however at times typographical or other errors may occur. In the event that a Product or Service is listed with the incorrect price or with incorrect information due to an error in pricing or service information, Trolleybay may at its discretion either contact You to instruct, or cancel the order and notify You of such cancellation. If We cancel the order, We will refund You the full amount to Your account from which the payment was made. Trolleybay reserve the right to modify any prices or information of the Product or Service at any time.
6.3 Under any circumstance, for any typographical or other error for the Products or Services offered displayed including but not limited to incorrect price or incorrect information, Trolleybay maximum liability will be subject to maximum of refund of full amount charged.
7. Credit Card Details
7.1 You might use Your credit card or debit card to make purchases on Our Website. You will in such case be required to provide your card details to the approved payment gateways while making the payment. Hereby, You agree to provide absolutely correct and accurate details of Your card to the approved payment gateways for availing Services on Our Website. You shall not use any cards, which lawfully is not owned by You and must use only Your own credit or debit card for all transactions.
7.2 Furthermore, You give Us your consent that the card details or other information provided by You will not be shared with any third party unless demanded by law and regulation bodies such as courts for fraud protection purposes. You shall be solely responsible for security and confidentiality of Your own credit or debit card.
7.3 Trolleybay expressly disclaim all liabilities that may arise as a consequence of any unauthorized use of Your credit/ debit card.
8. Shipping and Delivery of the Product
8.1 You shall be required to provide correct shipping details while making any purchases. The shipping address, pin code will be verified with the database of Trolleybay before you proceed to the payment. There might be cases where your delivery address area may not be serviceable by our logistics partners or the vendors or the area is not at all covered or You might have entered incorrect Pin Code, in such cases We would request You to provide us an alternative delivery address which we expect to have it in our logistics partner’s/ Vendor’s delivery list or serviceable list.
8.2 In cases where there is dispute for the delivery address of the customer, which is not covered by Trolleybay or Our logistics partner or Our Vendor, Trolleybay will not be responsible for the non-delivery of the product.
8.3 You may proceed with order for multiple Products or Services at the same time in one transaction, which Trolleybay will try to deliver all such Products or Services together and at the same time. However, We do not guarantee delivery of all the Products and Services at the same time due to product characteristics and or logistics issues as it is very likely that the products you have ordered might be supplied by different Vendors. If You purchase multiple products at the same time in a single order, We will ship all the products to a single delivery address at the same time. If You wish Us to ship individual Products or Services at different addresses then You need to place different orders for individual Products separately.
8.4 Currently we do not ship internationally but You can place orders from anywhere in the world but ensuring that the delivery address is within India and is serviceable by Our logistics partners and or by Our Vendors.
9. Return Policy of the Product
9.1 In the event if You receive a damaged / defective Product or a Product that does not conform to the specifications as per your original order, You are requested to please get in touch with the customer service at the call centre or Contact Us using the Contact Us link at the bottom of Home Page.
9.2 Upon receiving Your complaint, Trolleybay shall verify the authenticity and the nature of the complaint and if Trolleybay is convinced that the complaint is genuine, Trolleybay will inform the relevant Vendor of such complaint and either request for a replacement or full refund. If the complaint is frivolous or baseless, Trolleybay reserves the right to take legal actions against You and You will be solely liable for all costs incurred by Trolleybay in this regard. You further acknowledge that the Vendor selling the defective Product/ Service will be solely responsible to You for any Claims that you may have in relation to such defective Products/ Services and Trolleybay shall not be held responsible or liable in any manner whatsoever.
9.3 Kindly ensure that the Product’s packaging is not damaged or tampered before accepting shipment of any Product. If in case you observe that the packing of the Product has been tampered or damaged, kindly do not accept the delivery of the shipment as the contents of the package might have been lost or damaged. Kindly ensure You inform Us immediately about the same. The return process of the product might be restricted depending on the nature and category of the Product.
9.4 In order to return any Products purchased through Our Website, You are required to comply with the below mentioned conditions, viz:
- Please notify Trolleybay of receipt of a damaged/ defective Product/Service within 48-hours of delivery to You. If You are unable to do so within 48-hours, Trolleybay shall not be held liable for the failure to replace the order;*
- Products should be unused;*
- Trolleybay will arrange pick-up of the damaged/defective Product through its own logistics partner. If Trolleybay is unable to do so, Trolleybay will notify You regarding the same and You will be required to dispatch the product using a reputed courier in Your respective area within one (1) day from receipt of such notice. Courier freight charges will be reimbursed in such form as is determined by the logistics team upon prior consultation with Trolleybay;
- Products should be returned in their original packaging along with the original price tags, labels, barcodes, user manual, warranty card and invoices etc.;
- It is advised that the return packets should be strongly and adequately packaged so that there is no further damage of products during transit;
- The returned Products are subject to verification and checks by Trolleybay in order to determine the legitimacy of the complaint/ return. If the claim is not legitimate, you will be required to bear the shipping costs for the product.
* These conditions will not apply to Products where the defects could not, using reasonable diligence, have been discovered, at the time of delivery.
9.5 If a Product returned is duly accepted by Trolleybay, the value of such Product, as originally paid by You will be refunded to You. Refund will be processed based on the mode of payment and Trolleybay or the approved payment gateway will credit Your refunds directly into Your debit/credit card or online accounts or provide You with a cheque in this regard. Refunds will be subject to the following:
- Orders paid online will be refunded within 7-21 working days through the online account or via cheque, depending on the then current circumstances as determined by Trolleybay;
- For Cash on Delivery payments, You will be provided with a refund cheque or through Online Bank Transfer after realization of payment from Our logistic partner.
- If the Product can be repaired by the service centre, Trolleybay will get the same repaired and send it back to You.
- A promo code, once used shall not be refunded in case of cancellation of order either by customer or Trolleybay.
10. Order Cancellation
10.1 Cancellation by Trolleybay: There may be certain orders that Trolleybay is unable to accept and must cancel. Trolleybay reserves the right, at Trolleybay's sole discretion, to cancel or refuse any order at any point of time for any reason whatsoever. Some situations that may result in Your order being cancelled include, without limitation, Your Pin Code not servicable by Our Logistic Partner, non-availability of the Service ordered by You, non-availability of the Product or quantities ordered by You, inaccuracies or errors with respect to pricing information or in product description, or problems identified by Trolleybay' credit and fraud avoidance department. Trolleybay may also require additional verifications or information before accepting any order. Trolleybay will contact You if all or any portion of Your order is cancelled or if additional information is required to accept Your order. If Your order is cancelled after Your credit card has been charged, the said amount will be reversed back in Your credit card account. A promo code, once used shall not be refunded in case of cancellation of order either by Customer or Trolleybay.
10.2 Cancellation by the User In case of requests for order cancellations, Trolleybay reserves the right to accept or reject requests for order cancellations for any reason whatsoever. As part of usual business practice, if Trolleybay receives a cancellation notice and the order has not been processed/ approved by Trolleybay, Trolleybay shall cancel the order and refund the entire amount to You within a reasonable period of time. Trolleybay will not be able to cancel orders that have already been processed. Trolleybay has the full right to decide whether an order has been processed or not. You agree not to dispute the decision made by Trolleybay and accept Trolleybay’ decision regarding the cancellation.
10.3 Trolleybay reserves the right to cancel any orders that classify as 'Bulk Order' as determined by Trolleybay as per certain criteria. Any Trolleybay Promo Code used for placing the 'Bulk Order' will not be refunded as per this cancellation policy. An order can be classified as 'Bulk Order' if it meets with the below mentioned criteria, which may not be exhaustive, viz:
1. Products ordered are not for self-consumption but for commercial resale
2. Multiple orders placed for same product at the same address
3. Bulk quantity of the same product ordered
4. Invalid address given in order details
5. Any malpractice used to place the order
11. Failure to Sell by Vendor
Unless due to Your negligence, in the event the Vendor fails to complete a sale of a Product or a Service when presented by You with a valid Voucher or otherwise, You acknowledge that the Vendor will be solely liable to reimburse such amount as has already been paid by You for the purchase of such order. Further, You agree and indemnify Trolleybay that Trolleybay will not be held liable for failure of the Vendor to make available any Product or Service therein as Trolleybay is only providing a platform to You for providng such Products and Services sold by different Vendor(s).
12.1 The Website, Services, and all the materials and products including but not limited to software, made available on the Website are made available by the Trolleybay on “As in”, “When is”, “Where is”, and “As available” basis without any gaurentee or warranty of any kind, express or implied except otherwise specified in writing. Without prejudice to the above, Trolleybay makes no warranty that i.) The Website including the products and Services will be constantly made available for Your use or will be uninterrupted, secure or error free or will meet Your requirements;
i.) The Website including the products and Services will be constantly made available for Your use or will be uninterrupted, secure or error free or will meet Your requirements;
ii.) The information, data, product or service made available on this Website is complete, accurate, true, reliable, and not-misleading;
iii.) The Quality of the Website, Services, Products or other materials will meet Your expectations;
iv.) Any errors, omissions, or defects in the Website, Services or products will be corrected;
12.2 Trolleybay does not control, endorse or accept responsibility or liability for any Product (including but not limited to Product Catalogues) or Services offered by Third Parties accessible through the Website or any linked sites. Trolleybay makes no representations or warranties whatsoever about, and shall not be liable for, the Vendor or any such Third parties, their Products or Services, including representation relating to Intellectual Property Rights, Privacy, Publicity or any other laws. Any transaction that You may make with such Third Parties are at Your own cost and risk.
12.3 Products and Services are made available on the Website through the respective Vendors who are the Sellers of such Products and Services and shall be subject to Vendor’s Terms and Conditions for Warranty, Service and Maintenance, and Trolleybay does not accept any responsibility for the same. Trolleybay also does not accept any responsibility for the usage of the Products by You.
12.4 Trolleybay specifically disclaims any liability with regard to any defective or counterfeit products purchased or service availed by You from the vendor and Trolleybay shall not assume any liability if the product purchased or service availed by You from the vendor is not exactly as per specifications detailed in the purchase confirmation order.
12.5 All the Products or services sold on the Website are governed by different state laws. If in case the Vendor who is the seller of Product / Service is unable to deliver such products or services due to repercussions of different state laws, Vendor in that case will return or will give the credit for the amount received (if any) in advance by the Vendor from the sale of such products or services not delivered to You.
13. Indemnifications and Limitation of Liability
13.2 Nothing contrary to above, In the event that if we are held responsible for any loss or damage in regards to a product, Our aggregate liability under this Terms of Offer of Sale or otherwise shall be limited to the refund of the money paid by You for any voucher or product or service, under which the unlikely liability arises.
13.3 Trolleybay shall not assume any liability for the non-availability of the Product, delay or failure to delivery of the Product and the installation of the Product or Service where required or any action or inaction that might be taken by the Vendor after issue of the Voucher to the User.
13.4 We try our utmost to keep your details and payment secure. However, We are not responsible for any unauthorized access to any details provided by you. User(s) are solely responsible and liable for the safety and secrecy of personal and non-personal information.
13.5 The dimensions, product descriptions, product images, selling price displayed on Our Website are only approximate and may not match with physical product but We do try our best to make sure they are as accurate as possible. The product description shown on Our Website are correct to the best of Our knowledge, however if You find that there is a mistake in the description, We may amend it upon information and verification with immediate effect. We however, will not be liable for all loss that you may have incurred due to such incorrect information or description. The product images displayed on Our Website is a fair reflection of the physical products. However, We cannot guarantee that the appearance and colours of the products shown is an exact replica to the appearance and colours of the actual product itself. Accessories shown alongwith the product may or may not be a part of actual products. 13.6 Prices, Scheme, Taxes are applicable at the time of Invoice creation by the Vendor for the Product/ Service sold by Vendor irrespective of when you placed your order.
13.7 Goods once sold shall be returned only as per our return and cancellation policy.
14. Applicable Law
14.3 Mascot Retail Pvt Ltd. shall have general lien on all Goods, Products and Services for the money due between the User(s) or that of between User and that of Trolleybay during utilization/ exchange/ sale/ purchase on the Website.
WE ASSUME ALL THE TERMS AND CONDITIONS LINKED AND MENTIONED ABOVE HAVE BEEN READ, UNDERSTOOD, AND AGREED BY YOU.
